Tonev Limousines, Atlanta's premier limo company 404 914 5525   Service Terms and Conditions Contract Contract Terms as referred to You - Means the person(s) requesting service(s), booking reservation(s) and using the service(s) of Tonev Limousines. Applies to any typing combination of lower case and capital letters. Client(s) - Means the person(s) requesting service(s), booking reservation(s) and using the service(s) of Tonev Limousines. Applies to any typing combination of lower case and capital letters. Provider - Means the company / business and the people working for it, which will honor the requests of its client(s). Applies to any typing combination of lower case and capital letters. Tonev Limousines - Means the provider of services that you the client has requested. Applies to any typing combination of lower case and capital letters. Limousine(s) - Means any type of vehicle(s) provided as requested by you for your reservation. Applies to any typing combination of lower case and capital letters. Chauffeur - Means the person hired by / associated with / affiliated with / Tonev Limousines responsible for driving the limousine that you requested for your reservation. Applies to any typing combination of lower case and capital letters. Deposit to secure limousine service For Lincoln Town Car (Sedan - 3 passengers) reservations, a 30% down payment (non-refundable) must be paid at the time of the reservation in order to secure it. Down payment is calculated 30% (thirty percent) from the total balance due on your reservation. For all Stretch limousines and SUVs, a 50% down payment (non-refundable) must be paid at the time of the reservation in order to secure it. Down payment is calculated 50% (fifty percent) from the total balance due on your reservation. For all Buses, Antique / Classic vehicles, Carriages and Trolleys, 100% down payment (non-refundable) must be paid at the time of the reservation in order to secure it. Down payment is calculated 100% (one-hundred percent) from the total balance due on your reservation. For all other vehicles provided (Mini bus, Charter bus, Limousine Coach bus, Party Bus, Super Stretch Limousines, etc.) 100% down payment (non-refundable) must be paid at the time of the reservation in order to secure it. Down payment is calculated 100% (one hundred percent) from the total balance due on your reservation. For all reservations down payment will be charged upon cancellation. In case that no cancellation has occurred and the client has proceed with Tonev Limousines' services, than the client is obligated to pay the full amount (due at pick-up) quoted at the time of their reservation plus any extra service that the client has consumed. In some cases where the amount (due at pick-up) quoted is greater than $750 (seven hundred and fifty US dollars), down payment will be charged at the time of the reservation. Advanced Notice of Cancellation In case you need to cancel your reservation, you must call Tonev Limousine at 404 914 5525. All Sedan "Hourly-As-Directed" and Sedan "Transfer" reservations must be cancelled 48 hours in advance before your scheduled pick-up time. All SUV "Hourly-As-Directed" and SUV "Transfer" reservations must be cancelled 96 hours in advance before your scheduled pick-up time. All Stretch "Hourly-As-Directed" and Stretch "Transfer" reservations must be cancelled 4 days in advance before your scheduled pick-up time. Between March 1st and May 30th of each year the time for advanced notice of cancellation shall be at least 6 days. All Mini Bus / Mini Charter Bus / Charter Bus / Full Motor Coach / Full Motor Coach Limo reservations cannot be cancelled once appointment has been set and confirmed by Tonev Limousines. All Antique / Classic vehicle, Carriages, Trolley reservations cannot be cancelled once appointment has been set and confirmed by Tonev Limousines. All special occasion reservations such as "Wedding", "Prom", "Wine Tour" and others that apply, must be cancelled 6 days prior to the service date or as specified in the special instruction field (if applicable) of your conformational E-mail received at the time of booking your limousines service. If you cancel your reservation ahead of time prior to specified terms above, down payment will not be refunded as mentioned in the previous section above. No other charge shall occur unless specified in your conformational E-mail received at the time of booking. Change, Cancellation and No Show Policy For all reservations, if a change of address or time of pick-up / drop off is made after booking, there shall be a $75 change fee. Exclusion apply if the change in your reservation is being noted at least 48 hours (forty-eight hours) before your scheduled pickup time.* For all reservations which are not canceled with advanced notice as specified above, 100% (one hundred percent) from total due for your reservation shall be charged to you.* In case that the client(s) has not canceled his / her / their reservation in advance, Tonev Limousines will proceed with the requested reservation and appear on the requested address at the requested time. Tonev Limousines' Chauffeur will reach the client(s) by phone on the phone number provided at the time of the reservation. Tonev Limousines also will honor 15 (fifteen) minutes grace period for the client to respond. Grace period starts from the time Tonev Limousines' Chauffeur appears on the requested address at the requested time and makes the first attempt to reach the client by the phone on the provided phone number by the client. If the client does not respond by 15 (fifteen) minutes from the first attempt, the reservation will be canceled as "No show". "No show" cancelation of the client's reservation will be noted because the client is unreachable within the grace period. If such cancelation occurs, a "No show" fee equal to 100% (one hundred percent) from total due for your reservation shall be charged to you. To avoid either a late cancellation or no show fee, the reservation(s) must be cancelled in accordance with this cancellation policy and any other amendments noted in the email confirmation. To cancel your reservation you must call Tonev Limousines at 404 914 5525. Should you experience difficulty locating your chauffeur, please call Tonev Limousines' telephone number 404 914 5525. Leaving the pick-up location without notifying Tonev Limousines will result in a no-show fee. * Applies to all Sedan, SUV, Stretch Limousine and Van reservations where the pick-up location is within the Atlanta, GA USA metropolitan area. The metropolitan area is defined as within 25 miles of the city's center. All services requiring traveling outside the local city metropolitan area will be assessed the actual drive time to/from the pick-up location. All other vehicles are subject to rules stated in the "Advanced Notice of Cancellation" section of this "Service Terms and Conditions Contract". NOTE: All Special Event Change and Cancellation Policies supersede standard Change and Cancellation Policies if agreed prior to your reservation and is noted in the email confirmation. For all reservations requiring Antique / Classic Cars, Buses, Trolleys and Carriages, 100% (one-hundred percent) of the total reservation amount due will be charged upon cancellation, time / place change of pick-up or "No Show". Credit / Debit Card on file Whenever a Client makes a reservation with Tonev Limousines a credit card of acceptable type (VISA, MASTER CARD, DISCOVER, AMERICAN EXPRESS) should be put on file until the job is performed and paid in full by the Client. By making a reservation with Tonev Limousines, the Client automatically agrees and understands that the card on file will be charged for down payment and in case where any amount due to Tonev Limousines is declined / refused by financial institutions processing the transaction. Whenever a reservation is made the Client shall provide credit / debit card which has an expiration date well beyond the date of service. If the Client is not able to provide such a credit / debit card, in some circumstances pre-payment of the full amount due for services arranged may be allowed and shall be exactly documented as special circumstances amendment to this contract will be applied. Payment Due Whenever a Client makes a reservation with Tonev Limousines payment shall be made at pick-up. Down payment only covers a percentage of the total amount due in order to reserve your limousine (car service, car and chauffeur).The difference between the total due and down payment must be paid at pick-up of the Client. Credit / debit card provided by Client for down payment will be used as payment method for any outstanding balance due. Client shall have the option of paying cash, by credit card of acceptable vendor and banks. If specified by an authorized Tonev Limousines' representative, the Client may also be able to pay by check. Acceptable credit / debit cards are VISA, MASTER CARD, DISCOVER, AMERICAN EXPRESS. Unless specified by Client that he / she / they will use another method of payment at pick-up, the credit card supplied for down payment will be used to cover outstanding balance owed to Tonev Limousine. In case of declined credit / debit card the Client shall be immediately informed and he / she should immediately present another method of payment. If any payment made by Client is bounced, returned, or not sufficient, Client will be charged additional $200 (two-hundred U.S. dollars) or 20 (twenty) percent of the total reservation amount whichever is greater. Any such payment will be expected to clear banks' routing within 48 hours from the day those charges are added in addition and the new invoice is sent to the Client. Abandoning your limousine From the time a Client's reservation starts to the time the Client is dropped off at their final destination, he / she / they will be expected to be in constant communication with their chauffeur. If a Client needs to make a stop and go into enclosed destination, he / she / they will be responsible to call back the chauffeur on their way back to the limousine (car). Since Tonev Limousines' chauffeur cannot see through solid color objects, and must not keep track of anything not related to limousine transportation, the Client will be responsible for contacting their chauffeur. In case parking is not available in front of any business, at initial stop requested by Client, the chauffeur will be park at the nearest parking available. Whenever the Client needs back the limousine (car) he / she / they should call back their chauffeur and let him / her know. In case Client's chauffeur is unreachable due to phone service coverage interruption or any other unforeseeable reasons you must call 404-914-5525 or 404- 944-4142 for help to locate your chauffeur. If you leave your initial stop destination without contacting the chauffeur or Tonev Limousines, it will be considered as you abandoned the limousine (car) and our services. If you abandon the limousine (car) and our services, you will be responsible for total amount due for your reservation plus all extra charges (such as extra hours the chauffeur had to wait at your initial destination). To avoid extra charges associated with abandoning the limousine (car) and our services, please communicate with Tonev Limousines' chauffeur at all times or let him / her know where they need to park. Any fees associated with parking while your reservation is lasting will be charged to your final invoice "As Is". Garage-to-Garage Calculations Garage-to-Garage means charges are calculated by applying the applicable hourly rate commencing from the time the chauffeur departs the garage to begin service and continuing through such time the chauffeur concludes service and returns to the garage. The minimum number of billable hours appears in the estimate, however the actual billable hours may exceed the minimum. Wait Time - Airport Transfer Wait time is not charged for commercial flights unless clients choose to deviate from proceeding to the stated Client and Chauffeur meeting location. In such instances, wait time beyond 15 (fifteen) minutes will incur the transfer base charge plus the hourly charge prorated in 30 (thirty) minute intervals. Wait Time - Point-to-Point Transfer Clients are permitted 15 (fifteen) minutes of wait time after the scheduled pickup time. Wait time beyond the 15 (fifteen) minutes will incur the transfer base charge plus the hourly charge prorated in 30 (thirty) minute intervals. Extra Stops For all Point-to-Point Transfers: Clients are allowed to make one stop which does not exceed 10 (ten) minutes during a transfer. If the stop exceeds 10 (ten) minutes, the Client will be charged the transfer base rate plus the hourly charge for the vehicle in 30 (thirty) minute increments up to 45 (forty-five) minutes (rounded up) for the time that the chauffeur waits. If there is more than one stop, or if the one stop lasts more than 45 (forty-five) minutes, then the trip will convert to an hourly charge which will be added in addition to the original price of the transfer. Drop off address / Final destination The location or physical address at which the Client(s) / passengers will be left / dropped off and all business between Tonev Limousines and the Clients(s) is concluded. All reservations shall have drop off address / final destination stated and described by the client prior to Tonev Limousines performing its services. Fuel Surcharge For types of motor vehicles which Tonev Limousines and its affiliates offer for limousine services fuel surcharge will be factored in the total price quoted Rate Estimate Rates quoted prior to service are only an initial estimate of the cost of services reserved. Wait time and/or additional services may change the final price. Exchange Rate Any quoted rate is based on the exchange rate in effect at the time of booking. The final bill will be calculated using the exchange rate in effect at the time of billing. Child Safety Seats For safety reasons of providing age and weight appropriate equipment, Tonev Limousines does not provide child safety or booster seats. However, Clients may provide and install their own child safety or booster seats. Lost or Misplaced Items Tonev Limousines assumes no liability for any lost or misplaced personal property or any other items. Incidentals and Additional Charges Certain charges which are not included into base rates and total price due quoted at the time of the reservation. Include chauffeur hotel accommodations and meals, greeter fee, parking, port fee, special requests, tolls, damage* to Tonev Limousines' property by Client(s) and their entourage, as well as period of time which the vehicle is being repaired and unusable for business. Any damage* of any type done to Tonev Limousines' property by the client their entourage or affiliated passengers will be charged to the client's final invoice in full and beyond full market value to repair Tonev Limousines' property as appropriate. By making a reservation the Client automatically agrees that Tonev Limousines will not be responsible for clients / passengers who have abused alcohol, food and drugs. All damage* occurring to sickness will be charged at minimum of $500 (five hundred US dollars) plus full cost necessary for additional repairs and adjustments to make vehicle return to mint condition. Any incidental charges and additional fees will be added upon occurrence to the final invoice at the time of the Clients / Passengers drop off. By making a reservation the Client has full responsibility to pay those charges as they occur. *Damage is defined by: the occurrence of a change for the worse or the act of damaging something or someone, both done / performed by the Client(s) or their entourage participating in the hired vehicle. Impaired / Intoxicated Client(s) or Passenger(s) All impaired Client(s) or Passengers due to abusing alcohol or drugs, may be left at the destination where they have last departed the hired vehicle until sober. In case where the Client is accompanied by at least one sober aide passenger then Tonev Limousines reserves the right to proceed and drop off the Client(s) / passengers at the initial point of pick-up. Tonev Limousines reserves all rights to terminate any services at any time due to Client(s) / passengers abuse of alcohol and drugs. At the end of the day, the Client is fully responsible for the full cost of all services previously arranged and any additional costs occurring at the time while the Client(s) or their entourage is / are intoxicated due to abusing alcohol or drugs. If a Client(s) is left at the destination where they last departed the vehicle then Tonev Limousines can pick-up them up with an available vehicle on the next business day at an additional cost. If the Client(s) is sober sooner than expected then they can call Tonev Limousines' reservation line at 404 914 5525 and request and available vehicle to pick them up at an additional cost. Vehicle(s) Availability Tonev Limousines reserves the right to upgrade your vehicle(s) of choice at any time. Based upon availability and unforeseeable consequences (such as airport delays, previous arrangements running into overtime, traffic or weather conditions, etc.), Tonev Limousines reserves the right to upgrade your vehicle(s) of choice with another vehicle(s) of equal or greater value in order to provide you with the limousine services you have arranged for. All cancellation and change of time policies stay the same as previously described in this Service Terms and Conditions Contract. Airport Transfer The charge for a transfer to or from a commercial airport or FBO location to a predefined location. Hourly Charge The charge for "As-Directed" service when there is an itinerary involved or the chauffeur takes instructions from the Client; typically involves multiple stops. Point-to-Point Transfer The charge for predefined transfer from the most frequently traveled routes in a given market, separate and aside from airport transfers, as defined above. Base Rate The rate charged for basic transportation services before any Gratuity, Fuel Surcharge, Airport Fee, International Arrival Fee, Incidental Charges, and/or Tax is added.   Service Terms and Conditions Contract Updates Tonev Limousines reserves the right to make changes, amendments, updates to this Service Terms and Conditions Contract at anytime without previous notice or acknowledgement from both parties (Client and Limousine Service provider). It is Clients' responsibility, to obtain the latest version of this Service Terms and Conditions Contract as well as any amendments to it, for their references. Additional arrangements of the terms and conditions may be amended depending on the type of services performed. Please see our Prom Contract Agreement as well as Amendment to Your Limousine Contract and Minimum Hours of Service Requirement.
